A fist blow to the back of the head and other targeted blows were added, and when the young man was lying on the ground, it is said that there were kicks with the fists. The latter, however, could not be clarified beyond doubt in court.

Five versions of one process
The victim, who was considerably intoxicated with 1.9 per mille, suffered a schadel brain trauma, which had to be treated in the clinical center bamberg.
The indictment was silent about the couple's intoxication. The two brothers, however, admitted to having had quite a bit of tequila and beer. But one of them wants to have consumed only mixed drinks "because I don't drink pure beer". One of them had pushed the attacked man with his head down to keep him quiet "and the next moment the police were already there". What exactly the attacked had said, loved until the end not clear.

Defense counsel appeals for leniency – in vain
The only thing that is certain is that the brothers felt provoked. The aggrieved party was also unable to provide any information about the course of the dispute. He had only felt, but not seen, that he had been attacked with kicks. The older brother's girlfriend testified that she had not seen any kicks. The companion of the injured party, on the other hand, claims to have clearly observed these kicks. "This is already the fifth version that I have heard", district court judge silke schneider thereupon.
The public prosecutor demanded a fine of 3000 euro each for both brothers, the defenders naturally argued for a more lenient sentence. "If everyone involved had drunk a little less, nothing would have happened at all", defense attorney ludwig mieth appealed for understanding.
The verdict was finally 60 daily rates of 50 euros each. "The facts of the case were not sufficient to convict the defendants of dangerous bodily harm", district court judge silke schneider justified the verdict.
